Cezarys – Cezary Szczepaniak
1. Parties
The Service Provider is Cezary Szczepaniak / Cezarys. The Client is the individual or entity booking photography services from the Service Provider.
2. Services
The Service Provider delivers professional photography services as specified in the quotation or booking confirmation accepted by the Client. Services may include shooting, editing, and delivery of digital files and/or prints.
3. Booking & Payment
The date is confirmed once the quotation is accepted and the deposit or advance payment is received. Deposit amount, payment deadlines and terms are specified in the quotation. Until the deposit is received, the booking date is not secured. The fee may change if the Client alters the agreed scope of work after confirmation.
4. Delivery & Performance
The Service Provider will carry out the photo session at the agreed location and time. Edited images/files will be delivered in the agreed format and within the timeframe stated in the quotation. The Service Provider performs services with reasonable skill and care, but does not guarantee specific artistic results beyond that standard.
5. Copyright and Licence to Use
All photographs created by the Service Provider (Cezary Szczepaniak / Cezarys.com) are protected under copyright law, including the Polish Copyright Act (1994) and the UK Copyright, Designs and Patents Act 1988. All intellectual property and moral rights remain the exclusive property of the Service Provider, unless otherwise agreed in writing in a separate contract. Upon full payment, the Client is granted a non-exclusive, non-transferable licence to use the images solely for the purpose specified in the quotation or agreement (e.g., personal, promotional, editorial). Any other use, including resale, publication, advertising, or commercial printing, requires prior written consent. The Service Provider retains the right to use all created photographs in his professional portfolio, printed publications, exhibitions, promotional materials, the Cezarys.com website, social media, and fine-art prints. At the Client’s written request (before the assignment begins), the Service Provider may agree not to publicly display specific images. Any unauthorised alteration, editing, cropping, filtering, or modification of the images without the Service Provider’s written consent is prohibited.
6. Cancellation, Rescheduling & Force Majeure
If the Client cancels or reschedules, the terms specified in the quotation apply (including any non-refundable deposit). If the Service Provider cannot perform due to illness, equipment failure or force majeure, he will seek a replacement or refund paid fees. The Service Provider is not liable for indirect losses such as business or profit loss caused by delay or cancellation.
7. Limitation of Liability
The total liability of the Service Provider shall not exceed the total fee paid by the Client for the relevant assignment. The Service Provider is not liable for indirect or consequential losses.
8. Data Protection & Privacy
The Service Provider processes personal data in accordance with UK GDPR, DPA 2018 and his Privacy Policy. The Client consents to the processing of personal data for the performance of the services.
9. Governing Law & Jurisdiction
These Terms are governed by the law of England and Wales (or Poland, if specified). Any disputes will be settled before the courts of that jurisdiction.
10. General
These Terms constitute the entire agreement and supersede any prior understandings. Any amendments must be in writing and signed by both parties. If any provision is invalid, the remaining ones remain in force.
